1. Overview and Acceptance

Welcome to InspiraSpark.

This website is operated by Inspire Create LLC, doing business as InspiraSpark (“InspiraSpark,” “Company,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, and related services (collectively, the “Services”).

By using our website, creating an account, or placing an order, you agree to these Terms and our applicable Privacy, Refund, and Shipping Policies.

If you do not agree, please discontinue use of our website.

Our ecommerce store is powered by Shopify Inc.

Nothing in these Terms limits consumer rights that cannot lawfully be waived.

2. Eligibility and Website Use

Purchases must be made by individuals who are at least 18 years old or have reached the legal age of majority in their jurisdiction.

Product substitutions or material changes to an accepted order will not be made without required customer authorization.

We reserve the right to discontinue products, limit purchase quantities, or correct genuine website errors, subject to applicable law and existing customer rights.

4. Product Safety and Intended Use

InspiraSpark products must be used according to their current instructions, warnings, intended purposes, and applicable safety guidelines.

The Little Balance Box® is a developmental movement tool, not a substitute for adult supervision or professional medical evaluation.

For products requiring hands-on assistance during initial learning, that assistance must be provided by a responsible adult. Close adult supervision and assistance as needed remain necessary as the child progresses.

Product suitability depends on the individual user's developmental readiness, abilities, and circumstances.

Customers must follow all applicable age, weight, assembly, environmental, and usage restrictions in the product instructions.

Do not use a product that appears damaged, defective, improperly assembled, or unsafe. Discontinue use and contact InspiraSpark for assistance.

Nothing in these Terms excuses InspiraSpark from applicable product-safety obligations or legal liability for defective products.

5. Educational Information and Professional Advice

Our website may contain general educational information regarding movement, development, balance, and related topics.

This information is intended for general education and is not individualized medical advice, diagnosis, or treatment.

The fact that a product was developed by a physical therapist does not establish a healthcare-provider relationship between InspiraSpark and a customer.

Individual developmental concerns should be discussed with a qualified healthcare professional.

No specific developmental outcome, medical benefit, or milestone is guaranteed unless expressly stated in a legally compliant and substantiated product representation.

6. Pricing, Promotions and Payment

Product prices are displayed in the applicable currency and may change for future orders.

Taxes, shipping fees, and optional services will be disclosed at checkout as required by applicable law.

We may offer promotions, bundles, limited-time offers, and discounts.

Promotional terms may include eligibility requirements, expiration dates, product restrictions, or other clearly disclosed conditions.

Discounts generally cannot be combined unless expressly permitted.

We reserve the right to correct genuine pricing or technical errors. If an accepted order cannot be fulfilled at the represented price, we will notify the customer and provide an opportunity to accept any lawful correction or cancel for a full refund.

We will not impose undisclosed mandatory charges.

Payments are processed through Shopify and supported payment providers.

Customers authorize the total charge displayed and accepted at checkout.

7. Order Acceptance, Cancellation and Accuracy

Submitting an order does not guarantee acceptance.

Order changes may be requested within 30 minutes after purchase through the order confirmation link or customer support.

Carrier investigations may assist in resolving missing or disputed shipments but do not eliminate legal remedies available to customers.

Risk of loss and title pass in accordance with applicable law.

Customers should promptly report delivery issues and provide information reasonably necessary to investigate a claim.

9. Returns, Exchanges and Refunds

We generally provide a 14-day voluntary return window for eligible unused products, subject to disclosed conditions and exceptions.

Certain clearly identified products may be final sale.

The voluntary return policy does not eliminate rights relating to defective products, incorrect shipments, applicable warranties, or other remedies required by law.

10. Product Warranties and Consumer Rights

Certain InspiraSpark products include an express limited warranty, and eligible purchases may offer an optional extended protection plan.

Warranty coverage, duration, eligibility, and exclusions depend on the purchased product and applicable written warranty.

Any paid extended protection plan is subject to its own terms and applicable law.

Nothing in these Terms disclaims, restricts, or waives implied warranties or statutory remedies where doing so is prohibited by law, including applicable provisions of California's Song-Beverly Consumer Warranty Act.

Warranty limitations will be applied only to the extent legally enforceable.

11. HSA/FSA Transactions

Certain purchases may be eligible for payment using a Health Savings Account (“HSA”) or Flexible Spending Account (“FSA”) through supported providers.

Eligibility may depend on the specific product, purchaser's circumstances, plan requirements, and applicable tax regulations.

A Letter of Medical Necessity or other supporting documentation may be required.

Acceptance of an HSA/FSA payment method does not guarantee that a purchase qualifies for reimbursement or favorable tax treatment.

Customers remain responsible for confirming eligibility with their plan administrator or qualified tax professional.

InspiraSpark is not responsible for an independent plan administrator's eligibility determination, except to the extent that applicable law provides otherwise.

Any refunds involving HSA/FSA payments will be processed according to the applicable payment-provider rules and legal requirements.

12. Optional VIP Priority Handling

Customers may have the option to purchase VIP Priority Handling during checkout.

Where offered, VIP Priority Handling provides priority internal order processing and enhanced customer-service support, including prioritized assistance with eligible shipping claims.

VIP Priority Handling does not guarantee faster carrier transit or override the shipping method selected at checkout.

The service is optional, and its price must be disclosed before purchase.

If a VIP shipment is confirmed lost in transit, InspiraSpark will arrange an appropriate replacement or refund consistent with the service's advertised benefits and applicable law.

Charges for services already fully performed may be nonrefundable where legally permitted and clearly disclosed.

13. Intellectual Property

The InspiraSpark website and its original content, including text, product photography, videos, designs, logos, trademarks, graphics, and marketing materials, are owned by Inspire Create LLC or used under appropriate licenses.

Little Balance Box® and Hativity® are trademarks of Inspire Create LLC.

You may not reproduce, commercially distribute, modify, or exploit our protected intellectual property without permission, except where legally permitted.

Personal, noncommercial use of website materials is permitted only to the extent consistent with applicable law and these Terms.

14. Reviews, Comments and Customer Submissions

Customers may voluntarily submit reviews, product feedback, suggestions, and other communications.

By submitting an ordinary written review or comment for publication, you grant InspiraSpark a non-exclusive, worldwide, royalty-free license to reproduce, display, and distribute that review in connection with lawful business and promotional activities, provided we do not materially misrepresent your statements.

You represent that you have the rights necessary to submit the material.

This general provision does not grant InspiraSpark unrestricted advertising rights to identifiable photographs, videos, children's images, clinical footage, or independently owned creator content.

Separate authorization or an appropriate license may be required for such materials, including rights to use identifiable individuals' names, images, and likenesses in commercial advertisements.

We may moderate or remove unlawful, abusive, fraudulent, or inappropriate submissions.

We do not guarantee favorable reviews and will not knowingly misrepresent genuine customer opinions.

15. Affiliate and Creator Programs

InspiraSpark may operate affiliate, referral, creator, and brand ambassador programs.

Participation in those programs is governed by the applicable program terms or individually executed agreement.

Affiliate enrollment does not automatically authorize InspiraSpark to use a creator's content in paid advertising.

Content licensing, creator compensation, Partnership Ads, and other promotional rights may be addressed in separate agreements.

16. Third-Party Services and Links

Our website may integrate third-party services, including payment processors, ecommerce applications, analytics providers, advertising platforms, shipping providers, and customer-support services.

Those services may have independent terms and privacy practices.

We are not responsible for the independent acts or omissions of unaffiliated third parties except where responsibility cannot lawfully be excluded.

Nothing in this section limits our obligations as the seller of products purchased directly from InspiraSpark.

17. Privacy and Marketing Communications

To the extent permitted by law, you agree to reimburse InspiraSpark for reasonable, documented third-party losses arising directly from your intentional unlawful misuse of our website, infringement of another party's intellectual-property rights through material you submit, or material violation of these Terms.

This provision does not require you to indemnify InspiraSpark for its own negligence, defective products, statutory violations, or other wrongdoing.

Nothing in this provision limits mandatory consumer rights.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Disputes may be brought before a court of competent jurisdiction in California, subject to applicable consumer-protection and jurisdictional requirements.

Nothing in these Terms prevents consumers from accessing a court or remedy that applicable law requires to remain available.

Before initiating formal proceedings, the parties are encouraged to attempt good-faith resolution by contacting our customer-service team.

22. Changes to These Terms

We may update these Terms to reflect changes in our operations, products, website, or legal requirements.

The updated Terms will be posted with a revised effective date.

Changes will apply prospectively unless otherwise permitted by applicable law and will not retroactively eliminate rights arising under completed transactions.
