Referral Partner Program Terms & Conditions
InspiraSpark® Affiliate & Referral Partner Program Terms & Conditions
Effective Date: October 16, 2026
Company: Inspire Create LLC, doing business as InspiraSpark
Governing Law: California, United States
Welcome to the InspiraSpark Affiliate & Referral Partner Program (“Program”)!
We're excited to partner with creators, influencers, therapists, educators, professionals, and individuals who genuinely love our products and want to share them with their communities.
These Terms and Conditions (“Terms”) explain how our affiliate program works, including commission rates, referral tracking, payment schedules, eligibility requirements, promotional guidelines, and participant responsibilities.
By applying to, enrolling in, or participating in the Program, you (“Affiliate,” “Creator,” or “Participant”) agree to these Terms.
1. Program Eligibility
To participate in the Program, you must:
-
Be at least 18 years old.
-
Be a legal resident of the United States, unless otherwise approved by InspiraSpark.
-
Provide accurate registration, contact, and payment information.
-
Comply with applicable laws, advertising regulations, and social-media platform policies.
-
Be approved by InspiraSpark or participate through an eligible Shopify Collabs offer.
Participation is generally intended for individual creators and professionals. Businesses and agencies must obtain prior approval.
InspiraSpark reserves the right to approve, deny, suspend, or terminate participation for legitimate business, compliance, fraud-prevention, or Program-integrity reasons.
2. How the Program Works
The InspiraSpark Affiliate & Referral Partner Program is managed through Shopify Collabs.
Approved affiliates receive personalized referral links, discount codes, or both to share with their audiences.
Personalized referral links may automatically apply the affiliate's eligible customer discount at checkout.
Affiliates earn commissions on qualifying purchases properly attributed to their referral links or discount codes.
Customer Eligibility: Our standard affiliate settings currently apply to customers who have not previously purchased from InspiraSpark.
Purchases by existing or returning customers may not qualify for commissions unless otherwise specified in an individual affiliate offer.
Customer discounts and affiliate commission percentages may vary depending on the assigned program, promotion, or partnership tier.
3. Commission Rates
Our standard referral commission rate is generally 5% of qualifying net product sales.
Selected creators, influencers, therapists, brand ambassadors, and preferred partners may receive 10% commissions or another individually approved rate.
Your applicable commission rate is the rate displayed in your active Shopify Collabs offer or separately agreed upon in writing with InspiraSpark.
Commission rates may vary by:
-
Affiliate tier.
-
Product or collection.
-
Promotional campaign.
-
Customer eligibility.
-
Individual partnership agreements.
InspiraSpark reserves the right to adjust commission rates and incentives prospectively with notice through Shopify Collabs, email, or another reasonable communication method.
Commission changes will not retroactively reduce commissions validly earned before the change takes effect.
No specific commission rate is guaranteed indefinitely unless separately agreed in writing.
4. Qualifying Purchases and Commission Calculations
Commissions are calculated on qualifying net product sales properly attributed to the affiliate.
Unless otherwise specified in the applicable offer, commissionable sales exclude:
-
Sales taxes.
-
Shipping charges.
-
Discounts and promotional reductions.
-
Refunded amounts.
-
Canceled orders.
-
Chargebacks.
-
Gift cards purchased as stored value.
-
Other noncommissionable charges or transactions identified in the applicable offer.
Minimum Order Value: InspiraSpark currently has no additional minimum purchase requirement under its Shopify Collabs affiliate settings ($0 minimum).
However, purchases must still satisfy all applicable eligibility, tracking, and attribution requirements.
Commissions are not guaranteed on transactions that cannot be properly attributed to an affiliate.
5. Referral Tracking and 90-Day Attribution Window
InspiraSpark currently uses a 90-day affiliate link attribution window through Shopify Collabs.
When an eligible customer clicks an affiliate's approved referral link, qualifying purchases completed within the following 90 days may be attributed to that affiliate, subject to Shopify Collabs' attribution rules.
Referral attribution may be affected by:
-
Browser cookies and privacy settings.
-
Competing affiliate referrals.
-
Customer eligibility restrictions.
-
Tracking limitations.
-
Use of different devices or browsers.
-
Technical interruptions.
-
Applicable Shopify Collabs attribution rules.
Discount codes may also support attribution where permitted by the applicable Shopify Collabs offer.
The 90-day attribution window does not guarantee that every purchase within that period will generate a commission.
Affiliates can review attributed purchases and commissions through their Shopify Collabs dashboard.
InspiraSpark may change the attribution window prospectively with reasonable notice, subject to Shopify Collabs' functionality and applicable Program requirements.
6. Commission Holding Period — 30 Days
InspiraSpark currently maintains a 30-day commission holding period.
Commissions remain pending during this period to account for:
-
Order cancellations.
-
Product returns.
-
Refund requests.
-
Payment disputes.
-
Chargebacks.
-
Fraudulent transactions.
-
Other order eligibility issues.
After the 30-day holding period, eligible commissions may proceed through Shopify Collabs' payment processing system.
The 30-day holding period is not a guaranteed payment date.
Additional time may be required for billing, verification, processing, and payment disbursement.
InspiraSpark may modify the holding period for future transactions with reasonable notice, subject to Shopify Collabs' applicable requirements.
7. Commission Payments and Schedule
Affiliate commission payments are managed through Shopify Collabs.
Affiliates must complete the applicable payment onboarding process and provide valid payment information.
Supported payout methods generally include PayPal and eligible bank-transfer options, depending on location and Shopify Collabs' payment-provider requirements.
Once the applicable 30-day holding period has expired and commissions have been approved and successfully processed, eligible creator payouts are generally scheduled twice monthly through Shopify Collabs.
Actual payment arrival may vary due to:
-
Bank processing.
-
Payment-provider requirements.
-
Holidays.
-
Account verification.
-
Tax-documentation requirements.
-
Merchant billing issues.
-
Technical processing delays.
InspiraSpark remains responsible for valid commissions owed under the Program, subject to these Terms.
Affiliates can review their commission status, payout history, and available payment details through their Shopify Collabs account.
8. Minimum Payout Threshold
Shopify Collabs currently uses a $25 USD minimum eligible payout threshold for automatic commission payments.
If an affiliate's eligible commission balance is below $25, the balance generally carries forward until the applicable minimum payout threshold is reached.
InspiraSpark does not impose an additional minimum payout requirement.
The minimum payout threshold and related processing procedures may change in accordance with Shopify Collabs' platform policies.
9. Refunds, Returns, Cancellations and Chargebacks
Commissions are not payable on fully canceled or fully refunded orders during the applicable holding period.
If an order is partially refunded, the associated commission may be adjusted to reflect the eligible retained purchase amount in accordance with Shopify Collabs' functionality.
Orders involving:
-
Chargebacks.
-
Payment disputes.
-
Suspected fraud.
-
Duplicate or manipulated transactions.
-
Ineligible customer purchases.
-
Other violations of Program rules.
may be reviewed, disputed, or adjusted.
If a commission has already been paid and a later refund, chargeback, or correction occurs, InspiraSpark may seek a lawful adjustment or offset to the extent permitted by applicable law and Shopify Collabs' functionality.
Valid, undisputed commissions will not be arbitrarily withheld.
10. Promotional Guidelines and Prohibited Activities
Affiliates must represent InspiraSpark honestly, accurately, and professionally.
Unless expressly approved in writing, affiliates may not:
-
Run paid advertisements promoting affiliate links or discount codes.
-
Bid on InspiraSpark trademarks or branded search terms.
-
Publish affiliate codes on unauthorized coupon or deal websites.
-
Impersonate InspiraSpark or its representatives.
-
Create websites or social-media accounts falsely appearing to be operated by InspiraSpark.
-
Make misleading product or promotional claims.
-
Make unauthorized medical, therapeutic, or developmental claims.
-
Guarantee developmental outcomes from InspiraSpark products.
-
Generate fraudulent, artificial, or self-referred purchases.
-
Engage in spam, deceptive messaging, or unsolicited mass promotions.
-
Offer unauthorized discounts, rebates, or incentives.
-
Misrepresent product availability, pricing, warranties, or benefits.
-
Manipulate tracking, cookies, referrals, or affiliate attribution.
Violations may result in suspension, termination, or disqualification of commissions connected to prohibited activity, subject to applicable law.
11. FTC Compliance and Affiliate Disclosures
Affiliates must comply with applicable Federal Trade Commission advertising and endorsement requirements.
Receiving complimentary products, monetary compensation, or affiliate commissions may create a material relationship requiring disclosure.
When promoting InspiraSpark, affiliates must clearly and conspicuously disclose their applicable relationship.
Examples include:
“I earn a commission when you purchase using my code.”
“Gifted by InspiraSpark. I may earn commissions through my affiliate link.”
“Paid partnership with InspiraSpark.”
Disclosures must be appropriate to the format and sufficiently prominent for viewers to notice and understand.
Affiliates must not rely solely on ambiguous hashtags or discount codes where those methods do not adequately disclose the relationship.
Affiliates must provide genuine opinions and experiences and must not make false, misleading, or unsubstantiated claims about InspiraSpark products.
12. Product Claims and Safety
Affiliates must accurately describe InspiraSpark products and follow applicable product instructions and brand guidance.
Unless specifically authorized by InspiraSpark and supported by appropriate evidence, affiliates may not represent that InspiraSpark products:
-
Diagnose, treat, cure, or prevent medical conditions.
-
Cure or prevent developmental delays.
-
Guarantee walking, standing, balance, or other developmental milestones.
-
Replace medical care or professional therapy.
-
Guarantee specific developmental outcomes.
-
Are appropriate for every child regardless of developmental readiness.
-
Eliminate the need for adult supervision.
Where relevant, affiliates should communicate that the Little Balance Box® is a developmental movement tool and that appropriate adult assistance and supervision are required according to product instructions.
13. Brand Intellectual Property and Content Rights
InspiraSpark retains all rights to its:
-
Brand names.
-
Trademarks.
-
Logos.
-
Product photographs.
-
Product designs.
-
Marketing materials.
-
Website content.
-
Other proprietary materials.
Affiliates receive limited, non-exclusive permission to use approved brand materials solely for authorized Program promotion.
Participation in the affiliate program does not transfer ownership of an affiliate's original creative content.
Likewise, affiliate participation alone does not automatically grant InspiraSpark perpetual commercial rights to use an affiliate's original content in paid advertising.
Any additional content licensing, Meta Partnership Ad permissions, whitelisting rights, or other advertising usage rights may be governed by a separate InspiraSpark Creator Collaboration Agreement or written authorization.
14. Gifted Products and Additional Compensation
InspiraSpark may provide selected affiliates with complimentary products, promotional opportunities, higher commission rates, or special partnership incentives.
Receiving a gifted product does not automatically entitle an affiliate to monetary compensation beyond applicable earned commissions.
Any guaranteed appearance fee, content creation fee, speaking fee, or additional payment must be separately agreed in writing.
Unless otherwise specified, affiliate commissions remain governed by these Terms and the affiliate's applicable Shopify Collabs offer.
15. Taxes and Payment Verification
Affiliates are responsible for reporting and paying applicable federal, state, and local taxes on their earnings.
InspiraSpark currently requires U.S.-based creators receiving automatic payments to submit a completed IRS Form W-9 through the applicable Shopify Collabs payment process.
Payouts may be paused until required tax forms, identification, and payment verification have been completed.
Shopify Collabs and its payment providers may also request additional information when required by law or platform policies.
Applicable tax reporting forms may be issued as required by law.
16. Program Changes
InspiraSpark reserves the right to modify the Program, including:
-
Commission rates.
-
Customer discounts.
-
Affiliate eligibility requirements.
-
Attribution windows.
-
Commission holding periods.
-
Promotional rules.
-
Program incentives.
-
Product eligibility.
-
Program operations.
Material changes will be communicated through Shopify Collabs, email, the Program website, or another reasonable communication method.
Unless legally required or expressly agreed otherwise, changes apply prospectively and do not retroactively reduce valid commissions already earned.
Continued participation following the effective date of properly communicated changes constitutes acceptance to the extent permitted by applicable law.
17. Suspension and Termination
Either party may discontinue future participation in the Program.
InspiraSpark may suspend or terminate an affiliate for:
-
Fraud.
-
Material violation of these Terms.
-
Deceptive advertising.
-
Unauthorized trademark use.
-
Misleading product claims.
-
Manipulation of affiliate tracking.
-
Material violations of applicable law or platform policies.
-
Other legitimate Program-integrity or compliance concerns.
Upon termination, affiliate links, discount codes, and future commission eligibility may be discontinued.
Termination does not eliminate valid commissions earned before termination, subject to applicable refunds, chargebacks, adjustments, and payment requirements.
18. Independent Relationship
Participation in the Program does not establish an employment, partnership, joint venture, franchise, fiduciary, or agency relationship between the affiliate and InspiraSpark.
Affiliates are independent participants and have no authority to enter agreements, make warranties, or assume obligations on behalf of InspiraSpark.
Affiliates are responsible for their own business operations and applicable tax obligations.
19. Limitation of Liability
To the fullest extent permitted under California law, InspiraSpark shall not be liable for indirect, incidental, special, or consequential damages arising from participation in the Program.
Except for validly earned but unpaid commissions and liabilities that cannot lawfully be limited, InspiraSpark's aggregate liability arising from the Program shall not exceed the total commissions paid or payable to the applicable affiliate during the preceding 12 months.
Nothing in these Terms excludes liability or legal remedies that cannot be waived or limited under applicable law.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Disputes arising from the Program shall be subject to courts of competent jurisdiction located in California, except where applicable law requires otherwise.
Before initiating formal legal proceedings, the parties agree to make a reasonable, good-faith effort to resolve commission or payment discrepancies directly.
21. Severability and Entire Agreement
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain effective.
These Terms, together with the affiliate's applicable Shopify Collabs offer and any separately executed written partnership agreement, govern participation in the Program.
Where a separate signed agreement expressly provides different terms for a specific matter, that agreement controls for that matter.
