Referral Partner Program Terms & Conditions

These Referral Partner Program Terms (“Terms”) govern participation in the InspiraSpark Referral Partner Program (“Program”), operated by Inspire Create LLC, doing business as InspiraSpark (“Company,” “we,” “us,” or “our”).

By participating in the Program, you (“Participant,” “you”) agree to these Terms.

1. Program Eligibility

  • Participants must be 18 years or older

  • Participants must be legal residents of the United States

  • Participation is limited to individual consumers, not businesses or agencies

  • Program participation is subject to approval and may be revoked at any time

2. How the Program Works

  • Each Participant receives a unique referral link

  • Referred customers receive 5% off their qualifying purchase

  • Participant earns 5% commission on qualifying completed sales

  • Commission is calculated on net sales (excluding taxes, shipping, refunds, chargebacks)

3. Commission Eligibility & Payouts

Commissions are earned only when:

  • A referred customer completes a purchase using the referral link

  • The order is not canceled, refunded, or disputed

  • The order clears the applicable return window

Payout Details:

  • Payouts are issued via the Company’s designated affiliate platform

  • Minimum payout thresholds may apply

  • Payment schedules are determined by the platform provider

  • Inspire Create LLC is not responsible for third-party platform delays

4. Prohibited Activities

Participants may not:

  • Use paid ads, coupon sites, or deal aggregators

  • Misrepresent themselves as an employee or official representative

  • Make medical, therapeutic, or developmental claims beyond approved brand messaging

  • Use spam, unsolicited messages, or deceptive practices

  • Self-refer or create fake accounts

  • Offer unauthorized discounts or incentives

Violation of these rules may result in immediate termination and forfeiture of unpaid commissions.

5. Brand Use & Conduct

  • Participants may use brand assets only as provided

  • All promotions must be honest, accurate, and compliant with FTC guidelines

  • Participants must disclose affiliate relationships when required (e.g., “I may earn a commission”)

6. Taxes

Participants are responsible for:

  • Reporting and paying any applicable federal, state, or local taxes

  • Providing required tax documentation if requested

7. Termination & Program Changes

Inspire Create LLC reserves the right to:

  • Modify or terminate the Program at any time

  • Adjust commission rates, discounts, or eligibility

  • Suspend or terminate any Participant at its sole discretion

8. Limitation of Liability

To the fullest extent permitted by California law:

  • Inspire Create LLC is not liable for indirect, incidental, or consequential damages

  • Total liability shall not exceed commissions paid to the Participant in the prior 12 months

9. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of California

  • Any disputes shall be resolved exclusively in state or federal courts located in California
